The Legalities of Adoption

California law addresses several types of adoption, including:

Through adoption, the adopted child becomes the legal child of the adopting parent(s). Once an adoption is complete, the parents are responsible for providing support and care for the child, as well as a proper education. When a legal adoption is complete, the birth parents no longer have parental duties or responsibility for the child.

The Petition for Adoption will not be granted unless the overseeing judge is confident that the finalized adoption is in the best interest of the child. The judge does not consider if the adoption will be beneficial to the birth parents, the adoptive parents, or any other parties. Their only concern is the well-being of the child

In California, a child can only be placed for adoption by one or both of the child’s birth parents or a licensed adoption agency. It is a misdemeanor for any other party to place the child. This makes it a crime for even doctors or a California adoption attorney to choose adoptive parents.
