The sponsor must file Form I-129 or I-130 petition with the U.S. Citizenship and Immigration Services (USCIS). Once the petition is processed, USCIS forwards the approved petition to the appropriate U.S. Embassy or Consulate for continued processing. The beneficiary of the petition is then issued with an immigrant visa, and the visa application is approved. The beneficiary with an approved immigrant visa will then present the immigrant visa at a U.S. port of entry prior to the visa expiration date. The beneficiary becomes a lawful permanent resident (green card holder) once the immigrant visa and accompanying paperwork are examined and endorsed by a U.S. Customs and Border Protection Officer.
