Other than for those coming to the United States from countries where a visa is not required, everyone else wishing to come to the U.S. must first apply and obtain an entry visa. These visas are available in two broad categories: nonimmigrant (temporary) or immigrant (permanent) visas. The permanent visas are popularly known as “green cards” and are the most desired because they provide a pathway to U.S. citizenship. An immigrant visa or green card, as the visa is commonly known, is given to a noncitizen who intends to live and work permanently in the United States. You will need a sponsor to sponsor you for the green card, which is typically a close family member who is a U.S. citizen or green card holder or an employer in the U.S.
The sponsor must file Form I-129 or I-130 petition with the U.S. Citizenship and Immigration Services (USCIS). Certain applicants such as investors, individuals with extraordinary ability, and special immigrants can self-petition, meaning they do not need a sponsor but can file the petition on their behalf.
Once the petition is processed, USCIS forwards the approved petition to the appropriate U.S. Embassy or Consulate for continued processing. The beneficiary of the petition is then issued with an immigrant visa, and the visa application is approved. The beneficiary with an approved immigrant visa will then present the immigrant visa at a U.S. port of entry prior to the visa expiration date. The beneficiary becomes a lawful permanent resident (green card holder) once the immigrant visa and accompanying paperwork are examined and endorsed by a U.S. Customs and Border Protection Officer.
